These Terms and Conditions (“Terms”) govern your access to and use of Open Sesame! Kids Education, including our mobile application, website at https://www.opensesame.education/, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

1. Agreement to Terms

These Terms are a binding agreement between you and the operator of Open Sesame! Kids Education (“we,” “us,” or “our”), an individual developer based in Greece.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and may provide additional notice in the app or on our website. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms, unless applicable law requires otherwise.

2. Eligibility and Accounts

The Services are intended for use by adults such as parents, guardians, teachers, and educators who create and manage accounts. You must be at least the age of majority in your jurisdiction to create an adult account, or you must have permission from a parent or legal guardian.

When you register, you agree to provide accurate information and to keep your account information current. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

We may refuse, suspend, or terminate accounts that violate these Terms, applicable law, or our policies.

3. Use by Children

Open Sesame! Kids Education includes a student area designed for children to use educational features under adult supervision. Children should not create standalone adult accounts.

A parent, guardian, or authorized adult (“Guardian”) must create and manage student profiles and is responsible for:

By allowing a child to use the Services, the Guardian agrees to these Terms on the child’s behalf and consents to our collection and use of information as described in the Privacy Policy.

4. License to Use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use our mobile application and access the Services for personal, non-commercial educational purposes.

Mobile application distribution

If you download the app from Google Play or another authorized app store, your use is also subject to that store’s terms and policies. App store providers are not responsible for providing maintenance or support for the Services unless required by law.

5. User Content and Educational Materials

The Services allow users to create, upload, share, or publish content such as lessons, exercises, collections, books, images, comments, and other materials (“User Content”).

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, perform, distribute, adapt, and otherwise use User Content solely as necessary to operate, provide, promote, and improve the Services, enforce these Terms, and comply with law. This includes making public content available to other users when you choose to share it publicly.

You retain ownership of your User Content. We do not claim ownership over it, but we may remove or restrict content that violates these Terms or applicable law.

AI-generated content

Premium features may use artificial intelligence to help generate educational exercises or related content. AI output may be inaccurate or inappropriate if prompts are unclear or unsuitable. You are responsible for reviewing AI-generated content before using or sharing it with children.

6. Subscriptions, Credits, and Purchases

Some features require payment, such as premium subscriptions or credits for AI-assisted content generation. Purchases are processed through Google Play Billing or other authorized payment providers.

Credits, gems, energy, and similar in-app values have no cash value, are non-transferable, and may be modified or discontinued as part of the Services.

7. Third-Party Services and Content

The Services may integrate or link to third-party services and content, including Google, Facebook, Firebase, YouTube, OpenAI, translation providers, image services, and payment processors. Your use of those services may be subject to separate terms and privacy policies.

We do not control third-party websites, videos, APIs, or content and are not responsible for their availability, accuracy, legality, or practices. Access to third-party content is at your own risk.

Guardians are responsible for reviewing whether third-party content, including YouTube videos approved for a student, is appropriate for their child.

The Services, including software, design, text, graphics, logos, trademarks, and other materials provided by us, are owned by us or our licensors and are protected by intellectual property laws. Except for the limited license granted in these Terms, no rights are transferred to you.

If you believe content on the Services infringes your copyright, contact us at support@opensesame.education with sufficient information to identify the work and the allegedly infringing material.

10. Moderation, Suspension, and Termination

We may, but are not obligated to, monitor use of the Services and review User Content. We may remove content, restrict features, suspend accounts, or terminate access at any time if we believe it is necessary to protect users, comply with law, enforce these Terms, or maintain the Services.

You may stop using the Services at any time. You may also request account deletion through available in-app settings or by contacting us.

11. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that the Services will be uninterrupted, secure, error-free, or free of harmful components. Educational content, including user-created or AI-generated content, is provided for general educational purposes only and does not constitute professional teaching, medical, psychological, or legal advice.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR DEVELOPER, SUPPLIERS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) EUR 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless us from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

These Terms are governed by the laws of Greece, without regard to conflict-of-law rules, except where mandatory consumer protection laws of your country of residence provide otherwise.

If you are a consumer resident in the European Union, you may also benefit from mandatory protections of the laws of your country of residence.

Informal resolution

Before starting formal proceedings, you agree to contact us at support@opensesame.education and try to resolve the dispute informally within 30 days.

Jurisdiction

Subject to mandatory consumer law, the courts of Greece shall have non-exclusive jurisdiction over disputes arising from these Terms.
